Jason’s Law Update with Congressman Paul Tonko
Congressman Paul TonkoCongressman Paul Tonko was our guest on Truth About Trucking “LIVE” , Thursday, June 2nd, 2011 to give an update on the process towards more safe and secure parking areas for the nation’s truck drivers.
Known as Bill H. R. 1803, Congressman Tonko recently announced the re-introduction of the bill, more commonly known as Jason’s Law, in Washington, D.C. on May 11th, 2011.
Named after truck driver, Jason Rivenburg, we were also joined by his widow, Hope Rivenburg, who shared her continued works and efforts on this important issue.

Trucking Industry Unites as Jason’s Law is Re-introduced
Joined together at a press conference with Congressman Paul Tonko (D-N.Y.) at the House Triangle outside of the Capitol Building stood Hope Rivenburg, widow of truck driver Jason Rivenburg, along with:
Todd Spencer, Executive VP, Owner-Operator Independent Drivers Association (OOIDA)Lisa Mullings, CEO, National Association of Truck Stop Operators (NATSO)Richard Henderson, Director of Government Affairs, Commercial Vehicle Safety Alliance (CVSA)Paul Oakley, Senior VP, American Moving & Storage Association (AMSA) andMary Phillips, Senior VP, American Trucking Association (ATA).The press conference occurred 1 day after the press release from Congressman Tonko’s office. The press conference announced the introduction of the bill, Jason’s Law H.R.1803 which would provide increased truck parking facilities across the country, addressing the severe shortages which have been in existence for nearly 2 decades.
HR 1803 will be within an amended version of SAFTEA-LU within the new Transportation Bill. Funds for the bill will be from an existing congestion mitigation air quality account which would address Republican concerns for “no new spending.”
Hope Rivenburg will be lobbying once again, gathering support for co-sponsors. The Bill already has bipartisan support with Rep. Erik Paulsen, R-MN as an original co-sponsor. HR 1803 has now been referred to the House Transportation and Infrastructure Committee.
Jason’s Law would create a grant program of 20 million dollars per year over 6 years that would help alleviate the parking shortages and help pay for expansion and safety improvements at existing rest areas. Many of the country’s rest areas have been forced to close because of the lack of state funds which has added to the already critical shortage of truck parking. Sections of HR 1803 will address these rest area closings as – “Truck Parking Inventory.”
The bill will address construction of new parking, improvements to existing commercial parking areas, tracking of open parking spaces and improvements to existing non-commercial parking facilities accommodating large trucks.
Two years ago a similar bill, HR 2156 was introduced by Congressman Tonko to Congress after one of his constituents of Schoharie County, truck driver Jason Rivenburg, was shot and killed as he parked to rest for the evening at an abandoned gas station in South Carolina. Because of the isolated location of the gas station, Jason was an easy target for crime (robbery) and his life was taken for a meager $7.00.
He left behind his pregnant wife Hope, a 2 year old son Josh and unborn twins. Unfortunately, this sort of criminal activity is way too common for many truck drivers as they struggle to locate safe haven to rest, finding themselves at many times, to be” sitting ducks” for criminal opportunists due to the truck parking shortages.
The lack of truck parking also causes highway risks as drivers are forced to drive tired attempting to locate available parking, forced to park on exit and entrance ramps and risk breaking federal HOS laws.
Hope Rivenburg spoke to us today and has expressed her gratitude for everyone coming on board with Jasons Law, including Lisa Mullings, CEO of NATSO who personally told her that NATSO is a strong supporter of Jason’s Law.
The bottom line is that the trucking industry is in agreement that the safety of truck drivers should be a major focus. The new federal regulations and proposals being placed upon drivers will greatly enhance the dangers of the truck parking shortages existing. As highway safety is a major concern of the DOT and FMCSA, the need for more truck parking is a vital and key piece to ensure their goal of safety for all.
Hope Rivenburg is a nominee for the “Making a Difference Award” which will be presented at the First Annual Truck Driver Convention in October in Tunica, MS.
Unity and Support for the professional CDL driver will be the theme of this ground breaking event. Politicians Getting more Pressure to Support Jason’s Law
The biggest concern for many is the funds from the Highway Trust Fund ( collected from gas and diesel fuel tax) which in the past, did not appear to be adequately or properly allocated in the highway program to sufficiently address the needs for the truck parking shortages.
It was the murder of truck driver Jason Rivenburg that first began the public awareness for the truck parking shortage. The FMCSA has acknowledged the need for more truck parking for many years now, however, funding to address the problem has been limited to say the least . Correlation between the lack of truck parking, truck driver fatigue, and highway fatalities has now peaked political and public interest alike.
Bills HR 2156 and S971 were submitted in April and May of 2009 by Congressman Paul Tonko and Senator Charles Schumer, both of NY state where Jason Rivenburg was a resident with his wife Hope and children.
Hope Rivenburg, Jason’s widow, has orchestrated the 3 call in’s to Washington with the support of Congressman Tonko.
The first call in on June 28th by Jason’s Law supporters was directed to House and Senate representatives.
The second call in on September 15th was directed to Senator Charles Schumer’s office, with focus that day quickly transferred to the Transportation and Infrastructure committee in the House ( HR 2156) and the Environment and Public Works Committee of the Senate( S971) It was this call in to Washington that has raised the most awareness and acknowledgement for more safe truck parking.
The last call in on Sept 29th was targeted towards the chair of the Transportation and Infrastructure Committee, James Oberstar and also the chair of the Environment and public Works Committee, Barbara Boxer. Also called that day were other members of these committees:
John Mica(R- Transportation and Infrastructure, John Duncan ( R- Highways and Transit sub-committee), and Peter Defazio (D- Highways and transit sub-committee) Transportation councils and communication directors from all committees expressed their deep concern for the need for truck parking and understand the strong correlation to highway safety.
According to those we ‘ve spoken to, Jason’s Law ( which will replace SAFTEA LU) will be a significant part of the new highway program.
Re-authorization of the Highway Program funds will take place in 2011. ( From Highway Trust Fund)
Ironically, the state of New York, a state that has had truck parking shortages for years, closed 6 more rest areas in an effort to save money.
This has sparked outrage among Jason’s law supporters and truck drivers nationwide. Hope Rivenburg was furious when she heard that her home state of NY was adding to the already dangerous truck parking shortage situation. She has now called for a protest of the New York state rest area closings. The state has other options than to close their badly needed rest areas, including 7 million dollars in SAFTEA LU which states can apply for ( grant money.)
The protest is scheduled to begin on Oct 31st, with truckers from all over meeting at the NY Schodack rest area on Interstate 90 westbound between exits 11 and 12. READ MORE
The NewYork state” rest area closings and truck driver protest” will no doubt bring even more awareness towards truck parking shortages and the need for Jason’s Law.
Hopefully the protest will lead to Jason’s Law being a topic of discussion in Congress after the elections, during the lame duck sessions, creating even more awareness before the January 2011 sessions and the re-authorization of the highway program.

Link between Human Trafficking, CDL Training, and Jason’s Law

Recently the awareness for human trafficking within truck stops has been a serious topic of discussion, and truckers are being educated and made aware in order to help combat the problem. The human trafficking industry is a billion dollar industry, destroying millions of lives worldwide, including hundreds of thousands in the United States.
To understand human trafficking one must understand that many human trafficking victims within the USA are runaways , kidnap victims, or immigrants brought to the US with hopes of a better life. All groups are forced into either slave labor or prostitution , much of which occurs at truck stops. This is no secret to truckers as truck stop prostitutes have been known as, “lot lizards” or “fender lizards.” What truckers haven’t known in the past however, is that many of these, “lot lizards” that are walking the truck stops, are actually victims of human trafficking, being forced into the world of prostitution.
Now that a national awareness is occurring for the human trafficking crimes taking place, truckers are becoming the ears and eyes for these types of incidents. More and more truckers are realizing that these “lot lizards” who many times were annoying to them, roaming the truck stops and knocking on their doors during the night and interrupting their sleep, are actually victims of horrific crimes.
The new truck driver awareness brought on by Truckers Against Trafficking and Chapter 61 Ministries has encouraged drivers to call the national hotline number 1-888-373-7888 when they see suspicious activity ( very young girls, bodily bruising/ scratching, do not speak English) This was the case for a trucker who saved 9 lives and broke up an organized multi state trafficking ring. Recently on FaceBook, we were made aware of another trucker who called authorities in Laredo, TX as he noticed suspicious activity and was able to save victims lives from human trafficking and forced prostitution.
Truckers Against Trafficking, Kendis Paris, will be conducting a seminar at the Memphis Trucking Expo on Octobers 23rd which we will be attending.
Kylla Leeburg, who is also one of the founders of the group has been on Truth about Trucking “Live” as well as other radio shows such The Truckstar Radio with Daniel Audet and Road Dog on Sirius satellite radio, discussing the need for truckers to become involved with the human trafficking problem.
Kylla, Kendis, and mom Lynn ( TruckersAgainstTrafficking) will also be having a series of webinars, which can be watched from your computer, designed to educate people (especially truckers) on how they can help eliminate human trafficking as it hides behind the mask of “willful prostitution.” The webinars will be brought to you with the assistance of Transport for Christ.
We’d like to bring to the attention an article that was in USA Today , which we believe actually ties together much of the criminal activity that truck drivers experience and face due to their lifestyle, specifically: the truck driver shortage, cdl training, lack of safe truck parking, and human trafficking.
The article basically spoke about the 459 unsolved highway murders that have occurred over many years, stating that most of the 200 suspects are long haul truckers. The fact is, that the lifestyle of trucking is an appealing cover for someone with a criminal mind. How easily they could blend in with the other 4 million drivers, having a legitimate job, and moving from state to state legally as they conduct their series of criminal acts.
At a time when the fear of a truck driver shortage is igniting CDL schools and Company training programs to be on peak recruitment, it is crucial that these schools and programs conduct a complete background check on all individuals, especially since many of these programs are funded through government grants and subsidies paid by our tax dollars. It would be unimaginable to think that a serial killer is being sent through CDL school and training on the backs of the American Tax Payer.
The article also brought up the problem with prostitution within the truck stops and travel plazas, but nowhere did it mention the problem of human trafficking with regards to prostitution , which we felt was odd that not one of those interviewed made the connection( NATSO or OOIDA), even though the topic has been of major concern within the trucking world. Also, no one mentioned the need for more safe trucking parking! This would have been a golden opportunity to discuss the need for Jason’s Law and how many of the drivers who are already suffering from the lack of available safe truck parking (which has drastically interfered with their ability to obtain their federally mandated 10 hours rest), also complain that their sleep is additionally interrupted by the many prostitutes who roam the truck parking areas knocking on their cabs. This should have been mentioned as most of the murdered victims discussed in USA Today were prostitutes!

We see the many of these problems relating:
1-The criminal suspects within the trucking industry can be deterred by a more complete and thorough background investigation of CDL student and driver applicants. This is a must if we are to maintain a well deserving respectable image for the professional truck driver.
2-the need for more safe truck parking ( Jason’s Law) which would alleviate much of the problems for drivers having to drive fatigued because of the lack of parking and also interrupted sleep by pan handlers, pimps and prostitutes….who very well could be human trafficking victims.
3- The human trafficking problem which exists in much of the truck stops and travel plazas, which also requires the need for more safe truck parking…the key word is “safe”

The Crusade for Jason’s Law and Safe Truck Parking Continues
“More Safe Truck Parking” is what you will be hearing on Wednesday Sept 29th, the 3rd National Call in Day for the support of Jason’s Law in both the House as HR 2156 and Senate as S971
Wednesday, supporters of Jason’s Law plan on calling their representatives, Congressman James Oberstar, the chair of the Transportation and Infrastructure Committee, and Barbara Boxer, the majority chair of the Environment and Public Works Committee. The House bill version of Jason’s Law ( HR 2156) remains dormant in the Transportation and Infrastructure Committee while the Senate version (S971) is in the Environment and Public Works Committee.
Two Weeks ago there was tremendous advancement as the call for more safe truck parking saw optimism in the Senate, as the office of ranking minority member within the Environment and Public Works Committee, James Inhofe, showed strong support for the bill. Read More
Advocates of Jason’s Law are continuing to spread their message for the need of more safe truck parking, seeking remedy for the severe truck parking shortage causing risk to truckers lives and also increasing the risks of highway fatalities.
The #1 supporter of Jason’s Law is Hope Rivenburg, widow of the late Jason Rivenburg for whom the bill is named.
Yesterday Hope, a native New Yorker, was interviewed on CBS 6- WRGB news, as the state closed 6 rest areas in attempts to save money. This will add to the already serious lack of parking situation that the State of New York, along with much of the Northeast, has experienced for many years. States closing rest areas are all too common recently because of their budget deficits.
The lack of truck parking is becoming even more dangerous of a highway risk as tired drivers are either forced to continue driving in a fatigued state or park in isolated areas, putting their lives at risk, as was the case for Jason Rivenburg who was shot and killed.
We encourage all to join in on September 29th to call your state reps and also Congressman Oberstar and Barbara Boxer, urging them to support Jason’s law and the crucial need for more truck parking.

Soon to be released Trucking CD Supports Jason’s Law
Allen & Ayers ProductionsTruck drivers will soon be seeing a new music CD filled with songs that focus on today’s trucking issues. Issues such as the DAC report, the high cost of diesel fuel and the general life of a trucker and the challenges they face. Not since the days of Red Sovine and C. W. McCall, has there been a true-blooded music CD generated for the men and women of trucking. Songwriters David Ayers and Barry Allen are about to change all of that.
Having swept the internet with their smash hit, “When the Big Rigs Don’t Roll“, the CD of the same title is expected to be released within the following weeks. With John Johnson performing the vocals, David and Barry wanted to put together a new, all original CD that would honor our nation’s truckers and shed light on the work and struggles that they endure on a daily basis. The talented songwriters,having won numerous awards, “When the Big Rigs Don’t Roll” has been played at rallies in Washington, D.C., New York, Pennsylvania, Texas, Georgia, Florida and all across the USA and has been featured on CNN, Fox News, Cox News papers and internationally and is still broadcast through out the trucking industry. Top Nashville music executives have referred to the song as an “Anthem comparable to the late, great hit “CONVOY” by C. W. McCall.”
One of the songs on the CD will be, “Say a Prayer for Jason“, a song dedicated to slain truck driver, Jason Rivenburg and in support of Jason’s Law, bill H. R. 2156. Listeners of the Truth About Trucking “LIVE” talk radio show had the opportunity to hear, for the first time anywhere, this moving musical melody, paying tribute to one of trucking’s fallen. The show aired live on Wednesday, July 7th, 2010 and Truth About Trucking “LIVE” was given exclusive permission by Allen & Ayers Productions to share a few of the songs on the soon to be released trucking CD. “Say a Prayer for Jason” and “The Trucking Brand” were two of the songs broadcast live for the first time and can only be heard on Truth About Trucking “LIVE.”
The show, “The Truck Driver Shortage Fabrication“, also provided an update on Jason’s Law as explained to Truth About Trucking, LLC by Mr. Todd Kohr, a staff member on the Highway and Transit Sub Committee: A perfect timing for “Say a Prayer for Jason” to be heard. This broadcast focused on how current CDL training procedures, CSA 2010 and cross border trucking all relate and help to create the so-called truck driver shortage. As one of our most listened to shows to date, listeners were able to hear for the first time, “Say a Prayer for Jason” and were advised about the news of the upcoming CD.
Since the 1970’s, truckers have not had a music CD produced and dedicated solely for them . . . I would say that it’s about time. We’ll keep you posted on the release date and remember . . . you heard it here first!

American Truckers and Organizations Unite for Jason’s Law
Monday June 28th, 2010, the trucking community stands in unison together for their support of Jason’s Law
With all the issues existing within the trucking industry today, none have brought together a more unified atmosphere among truckers, bloggers, organizations, social media participants, and radio shows, than the desire to see the much needed bill, Jason’s Law (H.R. 2156 and S971) passed into law.
The Jason’s Law bill will allocate 120 million dollars over a 6 year period to ensure that safety improvements are made ( including SAFE adequate truck parking) for rest areas and truck stops.
Hope Rivenburg, the widow of Jason Rivenburg for whom this bill is named, has made Monday June 28th, 2010 as the day for everyone to call their Senators and Representative and strongly urge them to Support Jason’s Law. The trucking community has strongly supported this day in unison together.
As you most likely know, Jason Rivenburg was murdered as he parked to rest in an abandoned gas station because he could not find safe suitable truck parking for his early morning delivery. Adequate and safe truck parking has been a major concern of truckers for many years, with promises in the past made to remedy the problem.
We are now all standing together to ensure that something be done and that the death of fellow truck driver Jason Rivenburg has not been in vain.
Jason’s widow Hope, has made numerous trips to Washington, urging lawmakers and government officials to support Jason’s Law. In a year when highway safety has taken a significant increased priority among government agencies, this bill should be 100% supported and should have been passed by now.
Hope and Congressman Paul Tonko, who is the originator of the bill HR 2156, has also made numerous pleas on Truth About Trucking “Live”, Allen Smith’s blog talk radio show. Hope and Congressman Tonko have also been guests discussing Jason’s Law on TruckStar Radio with Daniel Audet.
Hope was recently a guest on Road Dog Trucking Radio on the Lockridge Report, sharing her story and urging listeners to support this day. Many of the other shows on Road Dog Radio have also made numerous mentions of the June 28th Call to Action, strongly supporting this day and urging their listeners to take action.
Organizations are supporting this badly needed bill, including OOIDA, who on June 24th released a National Call to Action to their members for the participation of the June 28th Calling Campaign to Washington.
The Teamsters and ATA have also supported the need for Jason’s Law.
Now we must ensure that the government officials whom we’ve elected into office, do their part in recognizing the need for HR 2156, Jason’s Law. For some reason, this bill has been “stuck” in the Transportation and Infrastructure Committee. James Oberstar of Minnesota is the chair and John Mica of Florida is the ranking Republican.

The Subcommittee that appears to be “sitting on this bill” is the Highways and Transit.
Highways and Transit is chaired by Pete Defazio of Oregon and John Duncan Jr. of Tennessee is the ranking Republican.
Ironically, John Duncan has recently written an article about the dangers of distracted driving, obviously concerned about the “safety of drivers.”
